Conditions of Sale:
1 Payment Terms –
Net 30 days from date of invoice
RL Packaging reserves the right to charge overdue accounts with a monthly penalty equivalent to 2% (per month or part thereof) on the overdue balance. This rate will be subject to variation.
RL Packaging reserves the right to recover all costs incurred in the recovery of any overdue account balance. These costs will include legal, court and execution fees, and any recovery agent commission, fees and expenses, and any other costs incurred in tracing and recovering monies due or property, including any fees and costs of Receivers, Liquidators.
2 Claims –
•Damages to goods, shortages in the quantity delivered or wrong product supplied, must be reported to RL Packaging in writing within three days of receipt of the goods.
•Non-delivery of goods must also be notified in writing (preferably email) within 7 days of receipt of invoice. If these conditions are not met, RL Packaging’s contracted carrier will refuse liability and the responsibility of payment for the goods will revert therefore to, you, the customer.
3 Return of Goods –
•Goods cannot be accepted for return WITHOUT PRIOR CONSENT, which will only be given at the discretion of RL Packaging. A 15% handling charge of the value of the goods being returned will be made with a minimum administration charge of €20 (our errors and omissions excepted).
•Having gained our written approval, goods can only be accepted if in pristine condition and returned correctly packaged, and with all components included, or we will be unable to accept it.
•Transit damage liability only applies to goods in transit from RL Packaging to its destination. RL packaging is unable to accept any liability for goods damaged in transit back to us. We reserve the right to nominate the carrier to be used for any agreed returns.
4 Cancellation of Orders –
•Any confirmed order that is cancelled, or part cancelled by the customer prior to delivery may be subject to an administration charge of 15% of the order value and 25% for orders of non standard products. The customer also indemnifies the company against any further loss incurred as a direct result of the cancellation of a confirmed order. Cancellation must be advised in writing.
5 Reservations –
RL Packaging reserves the right to accept orders subject to:
•Price ruling at the time of despatch of goods. This includes any currency or other surcharges arising from factors beyond our control.
•Product specification being upgraded/altered without prior notice.
•Availability of goods/raw materials.
6 Retention of Title –
•Ownership of goods will pass to the purchaser when RL Packaging receives full cleared payment. Until we have received payment in full for all the goods, the goods shall remain the sole and absolute property of RL Packaging.
•Until such time as you become the owner of the Goods, you will store them and will procure that they are stored separately from your own goods or those of any other person and in a manner, which makes them readily identifiable as our goods.
•If the Goods, the property of which is with us, are mixed with goods, the property of which are with you or a third party, or are processed or incorporated therein before all payments for the Goods have been made, the product thereof shall become and or shall be deemed to be our sole and exclusive property and at no time shall the property of such product be, or deemed to be, with you. Such product shall be at your risk and it shall be your duty to insure the product.
•All goods supplied on LOAN remain our property at all times, at no times does title in these goods pass to you or your assigns. You are not licensed in any way to sell on any products supplied to you on LOAN. Failure to observe, comply or continue with the terms of any loan supply agreement will result in the repossession of any or all LOAN goods and may result in additional hire charges.
7 Warranty –
• All tools and machinery sold by RL Packaging come with a 12 month warranty from the date of purchase unless otherwise stated.
Within this period we, RL Packaging will service or repair any original parts free of charge provided the parts are determined defective in materials or workmanship upon examination by an employee of RL Packaging. Only use fasteners/consumables supplied by RL Packaging otherwise RL Packaging will not be responsible for breakdowns caused by the use of spurious products, hence repairs will not fall under our warranty agreement. The responsability of the safe use of any tools and/or machinery supplied by RL Packaging is passed on to the buyer upon receipt of invoice.
